Any changes will be effective only after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.

Information We Collect
CMP’s policy is to protect the confidentiality of the individually identifiable information that you provide, and we limit access to that information only to those with a need to know. CMP collects the information described in “Computer Information” from you. In addition, if you choose to complete certain forms or send us requests, you will be asked to provide the following information: full name, phone number, and e-mail address.
If your employer contracts for CMP’s consulting services, in order for CMP to complete the services, you may be asked to provide: (A) identifiers such as a real name, postal address, unique personal identifier, internet protocol address, email address, or other similar identifiers; (B) characteristics, such as age, sex, national origin, marital status, number of children, or others; (C) biometric, health, and medical information, such as heart rates, sleep patterns, physical measurements, psychometrics, saliva and stool and blood testing; (D) Internet or other electronic network activity information, including, but not limited to, information regarding your interaction with an internet website, application, or advertisement; (E) geolocation data; (F) audio, electronic, visual, thermal, olfactory, or similar information; (G) professional or employment-related information; (H) education information; and (I) inferences drawn from any of the information identified in this subdivision to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. CMP will not sell this information, and will only provide it to the contracted employer and/or service providers who have a need to know in order to provide testing services or similar services to CMP and/or your employer, or as provided in the “Information We Share” section below.
Computer Information
CMP logs your current Internet address (this is usually a temporary address assigned by your Internet service provider when you log in), the type of operating system you are using, and the type of browser software used. In addition, CMP may keep track of what portions of this Site you are visiting. CMP aggregates this information to help CMP improve or create a better experience for users of the Site. For example: CMP may upgrade those parts of the Site that are heavily visited.
Our website automatically records website usage information that we analyze statistically to track operational problems, to prevent fraud and to improve the effectiveness, security and integrity of the site. We do not use this information to track or record information about individuals. We will disclose this information to third parties only in aggregate form or as may be required by law. For each page that you visit, we collect and store the following technical information in what is called a web server log file:

- URL address of the CMP webpage visited

Information Collected from Other Sources
CMP may also acquire personal information from other sources who have the right to provide such information to CMP. For example, CMP may acquire 360 feedback from other colleagues in the business to inform their coaching program, or CMP may acquire address information from these sources to validate or update your address or to prevent fraud; demographic and lifestyle information to help CMP analyze our business’s performance or improve the Services; and information about your online and offline transactions and purchases to help CMP analyze or improve the Services. CMP receives personal information, such as your name and email address, from business partners when you participate in joint marketing promotions, events, transactions, or similar interactions with third parties with whom CMP has a joint venture or similar business relationship. The categories of sources that provide personal information to CMP include consumers themselves; data analytics providers; advertising networks; social networks; data brokers; operating systems and platforms; co-branded ventures; and our affiliated and related entities. CMP uses collected information consistent with this Privacy Policy and for the purposes described below.
How We Use Information
Except as expressly provided in an agreement with your employer, CMP may collect, use, retain, share, and store personal information collected from or about you for any of the following purposes:

CMP uses your personal information – such as your address – to respond to your inquiries and provide you with requested information; and to provide and improve our customer service. If your employer contracts for CMP’s consulting services, CMP will use the information in order to complete the services. In addition, CMP may use personal information to analyze and improve the performance, usage and operations of our services using internal or external software and tools; to better understand who is using the services and how; and to develop new products or services.

For example, CMP may use your personal information – such as your email address, telephone number, usernames, and other contact information – to respond to your inquiries; to provide you with information about Services; and to otherwise communicate with you as needed or permitted to run CMP’s business.

Sale of Information
CMP has disclosed but has not sold personal information to third parties for a business or commercial purpose in the preceding 12 months as described above. CMP does not sell the personal information of minors under 16 years of age without affirmative authorization. Disclosure of Information
CMP may disclose personally identifiable information you provide to third parties if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) complete the transaction, such as providing your shipping information to our carrier; (b) comply with legal process; (c) enforce the Agreement; (d) respond to claims that any information you provide violates the rights of third parties; (e) protect the rights, property, or personal safety of CMP, its users and/or the public; or (f) in relation to the sale, assignment, merger, transfer or acquisition of all or substantially all of CMP’s assets or shares by a third party.
In addition, CMP may share or disclose the personal information CMP collects from or about you when (i) CMP notifies you or obtains your consent; (ii) when CMP’s service providers need such information in order to provide a business service to CMP; or (iii) or in any of the following situations:
Affiliates: We share your personal information with affiliates, business units, and/or subsidiaries for business, operational, promotional, marketing, or other purposes consistent with this Privacy Policy.
Service Providers: CMP shares your personal information with service providers used to provide business, professional, or technical support functions for CMP; that help CMP operate its business; and that perform other activities in support of the services or CMP’s business. For example, we share your personal information with service providers who assist us with shipping your order; processing and responding to your inquiries; advertising and marketing the Services; or processing your payments. Examples include advertising networks and data analytics service providers CMP uses for marketing and advertising services. Legal matters; compliance with the law: CMP may disclose personal information collected from or about you to the government, insurance providers, or to other third parties to comply with applicable law; regulations; governmental and quasi-governmental requests and investigations; court orders; subpoenas or other legal process; or to defend ourselves in legal matters. Because we link to social media sites, and from time to time may include third-party advertisements, other parties may collect your personally identifiable information about your online activities over time and across different web sites when you visit this Site.

Encryption
CMP uses no encryption (data scrambling) on certain portions of the Site, but uses encryption on portions where you are transmitting financial information, such as credit card information. When you are on any web site that asks you for confidential information, you should check to see if the information being transmitted is encrypted in order to increase the security of your information. Keep in mind that there is no such thing as perfect security.
Limitation of Liability
Except as otherwise expressly provided in a signed contract with your employer, UNDER NO CIRCUMSTANCES SHALL CMP BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE FROM A CLAIM OF BREACH OF THIS PRIVACY POLICY. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law, or $5, whichever is less.
